Welcome to AugustTales.com. These Terms of Service (“Terms”) govern your use of our website, services, and marketplace features. By accessing or using the platform, you agree to these Terms. If you do not agree with these Terms, please do not use the site.
1. Eligibility
To use AugustTales.com, you must be at least 16 years old. By registering for an account, you confirm that you meet this requirement and that all information you provide is accurate and up-to-date.
2. Account Registration and Responsibility
You must create an account to participate in trades, sales, or auctions. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.
3. Marketplace Use
August Tales is a fan-first marketplace where users may trade, sell, or auction trade paperbacks, comic books, cards, collectibles, and similar items.
Trading: All trades must be one-for-one and executed in good faith.
Selling & Auctions: Users may list items for sale or auction at their own chosen prices. August Tales does not place pricing caps. All item listings must be accurate and in compliance with our content standards.
Prohibited Listings: Users may not list counterfeit items, prohibited goods, or infringing content.
We reserve the right to remove any listing or content that violates these Terms or undermines the trust and safety of our community.
4. Fees and Payments
We charge a flat fee of $1.99 per traded item. For sales and auctions, we charge 6% of the sale price plus a $0.60 transaction fee. These fees are deducted automatically during checkout.
All payments are securely processed through trusted third-party services such as Stripe or PayPal. By using our platform, you authorize us to deduct platform fees and agree to those processors’ terms of service.
We handle credit card processing and collect applicable sales tax on behalf of the marketplace, so individual users don’t have to.
5. Shipping & Fulfillment
For both trades and sales, users are responsible for selecting and completing shipping. We offer discounted USPS shipping labels through the site for convenience.
Users are responsible for proper packaging and timely shipment of items. August Tales is not liable for lost, damaged, or delayed shipments.
6. User Content
Users may upload original content such as fan fiction, forum posts, product listings, and images. By submitting content, you grant August Tales a non-exclusive, royalty-free license to use and display your content in connection with the operation of the site.
We do not permit content that is unlawful, threatening, obscene, infringing, or violates the rights of others. We may remove content or suspend accounts that breach these guidelines.
7. Account Termination
You may terminate your account at any time through your account settings. August Tales reserves the right to suspend or terminate any account that violates these Terms or disrupts the integrity of the marketplace.
8. Limitation of Liability
To the fullest extent permitted by law, August Tales shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the platform, including but not limited to disputes between users, transaction errors, or issues with third-party services.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles.
10. Modifications to Terms
We may update these Terms from time to time. Changes will be posted here with an updated effective date. We encourage you to review this page regularly to stay informed.
